Court Cases

Lookout Mtn. SuperTower

January 2006 - Lake Cedar Group "LCG" filed suit against Jefferson County in response to the JeffCo Commisioners denying the latest Lookout Mountain digital TV tower proposal, November 2005.

County Commissioners Dave Auburn and Jim Congrove found that the LCG proposal contained no evidence of compliance with tower setback zoning.

The Jefferson County Court ordered all parties to file briefs based upon the 20,000 page record of all hearings and submissions to the County Commissioners. The case was submitted to Jefferson County District Judge Jackson for final decision. On May23, 2005 Judge Jackson issued his decision stating that Lake Cedar's request for oral arguments was denied and the case was to be remanded to the Jeffco County Commissioners for a third and final time.
