U.S. Congress Passes the "Clarification of Certain Land Use in Jefferson County, Colorado Act (S. 4092) In the wee hours of this morning, a Texas Congressman pushed the Lake Cedar Group bill through the U.S. House of Representatives. If ever there was “special interest” legislation, this is it. The bill was “hotlined” through the Senate. “Hotlined” means the bill does not get the usual route of debate and committees and is set up so that unless someone objects, it goes through. This terrible bill lets Lake Cedar Group put up its Supertower and allows everything any of the Lookout Mountain broadcasters want, so long as it's “ok’d” by the FCC and not taller than existing towers. In many ways, Congress, through this bill (S4092) has just condemned property rights in your land and our community for the benefit of several mega corporations worth billions of dollars. This is not right. Not one member of the Colorado National delegation intervened to protect us. Not one Republican, not one Democrat. We have been sacrificed by those we thought represented us. Deb Carney, attorney for the CARE homeowners group, said the latest ruling very clearly permits the current board of commissioners to weigh all the factors in deciding whether the site should be rezoned to permit the proposed tower. "This gives our new county commissioners, finally, the green light to review the entire record and look at the alternative sites, the interference problems, the health dangers for us and the harm to our property values," Carney said. "In the end,

May 2006 - the Jefferson County Court of Appeals reversed the JeffCo Commissioner's 2003 approval of a boadcast TV/FM tower site on Mt. Morrison. The Court of Appeals cited three big mistakes made by the Board of County commissioners in approving the tower site on Mt. Morrison:
The Court of Appeals has “remanded” the case back to the Judge Munsinger to send it back to The Dener Post 5/05/06 Article O Demolition attempt brings down both TV towers June 2006 - What started out as a text-book perfect demolition of the WFXL Fox 31 TV tower in Southwest Georgia, only took a couple of seconds to end in disaster. For a moment, the WFXL tower fell away from a second nearby WALB tower, according to plan. But then, the guy wires which were intermingled with those that kept the WALB tower erect since 1967, flailed their way through the maze of steel cables, disrupting them to the point that the WALB tower lost its support, and collapsed mere seconds after the intentionally destroyed WFXL tower fell. The City of Golden - Lookout Mountain Condemnation for Open Space On April 12, 2006 the City of Golden filed a Petition in Condemnation (the start of eminent domain proceedings) to acuire 64-acres of land Lake Cedar Group (LCG) owns on Lookout Mountain. LCG's request to rezone this land for the Supertower was denied by the Jeffco Commissioners November 2005. Under current Jeffco Zoning, LCG cannot build any towers on this land. The City of Golden wants to protect the land from any development in order to preserve the mountain backdrop and return Lookout Mountain to its former glory as an Open Space park. Lake Cedar Group's (LCG) Misleading Tower Ad Campaign In January 2006, LCG began targeting private citizens with a negative ad campaign about the 730-foot HDTV SuperTower issue. The 30-second broadcast TV ad that says “a SMALL GROUP of People is PREVENTING US from bringing you the benefits of free over-the-air digital television” is airing 15-25 times a day on four stations.
